THE PILARS OF A DEMOCRATIC SOCIETY AND GOOD LAW AND ORDER

The Law is that set of rules established in every country to regulate the behaviour of society and its people. It is established on concepts of religion, morality, what is right and wrong, established rules which best maintain order, constructive business transactions, human relationships and generally harmony between people within communities. The Rule of Law or The Supremacy of Law, means that the law is above everyone and it applies to everyone, whether governor/ruler or the people, rulers or ruled. Nobody is above the law, nobody is exempted from the law, and nobody can grant exemption to the application of the law. Equality before the law – Every person is entitled to equal treatment before the law, regardless of race, religion, gender, or financial advantage. This means that every person is entitled to equal treatment by the various officers and organs of government which are appointed with the task of administering and enforcing the law. Elected Government – Every country belongs to the people/citizens of that country. The citizens elect the government to govern and administer the country on their behalf. The citizens of that country pay elected officials to do the job for which they are appointed. The Separation of Powers, also known as trias politica, is a model for the governance of democratic states, to prevent the abuse of power by governments. Under this model, the state is divided into branches, each with separate and independent powers and areas of responsibility. The normal division is into an executive, a legislature, and a judiciary. Legislative power means the power to make laws and is concentrated in the Parliament. Executive power means the power to implement laws and is given to the government. Judicial power gives the High Court power to decide whether laws are legal according to the Constitution. Separation of powers means that people in one of these three divisions should not control the other two divisions. In other words, the Executive should not have any power or influence over the High Court to prevent it determining that it has abused its power.

An apparently perfect system, which in modern society has several fundamental flaws:

1.   Corruption – Some governments have forgotten who they represent, and are influenced by powerful organisations, election supporters, wealthy oligarchs, or their own selfish ends. Governments are also tending to gradually entrench their power as well as promulgate laws which are slowly eroding the rights of citizens and communities. Government officials are also tending to forget who and what they represent, blindly applying crippling bureaucratic provisions without common sense, or simply using their power to select who may enjoy their rights dependant upon relationships or financial gains.

2.   Enforcement Agencies, Justice Systems, and Administrative Systems are under funded and understaffed. The road to achieve a finding or decision by an administrative body or a court is invariably a complicated, tortuous and lengthy one. The best way to prevent crime is exactly that.. .crime prevention. The more police officers patrolling the streets and being on hand, the less crime there will be. The more stress investigators are under due to work overload, the greater the likelihood that their investigation may be delayed and/or inadequately finalised.

3.  As a general rule Only the Wealthy enjoy Justice and the Poor Suffer Injustice. In most instances a person cannot enforce their rights without the assistance of a lawyer, which in modern times costs a lot of money. In the realm of administrative law and criminal law the wealthy can afford the best lawyers and resources to achieve their freedom or a curtailed punishment. The poor on the other hand can hardly afford a lawyer, let alone any other resources they require to conduct the best defence. In the realm of civil law, again, the wealthy can afford the best lawyers and resources, which places them at a distinct advantage over an opponent with weaker financial resources. The poor simply cannot afford a lawyer or to retain him for the period required to conclude any dispute.

 

SO WHAT IS THE SOLUTION?    

A.   Re-educate society and government on the fundamental pillars of our democratic society

 We have forgotten that many of our ancestors fought and many paid the ultimate sacrifice to achieve our freedoms and rights. Modern society has become apathetic and submissive, no longer believing that they have the right to assert themselves. Our education systems should ensure that all citizens know the country’s history, the basis of government "for the people by the people", and the pillars of democratic government and the Rule of Law. Likewise, government and public officials should be reminded of the necessary fundamentals of good and responsible government in accordance with these principles.

 B.  Guarantee the enforcement of legal rights

 As much as I believe that every citizen is entitled to good health and education, I also believe that every citizen has the fundamental right and entitlement to the enforcement of their legal rights. I believe the only way to ensure this is to remove the financial qualifications and inequalities in the system, and require that all lawyers be employed by the state. An appropriate nominal fee payment system could be adopted as well as appropriate administrative features to remedy those arguments against this form or system of administration of justice. In this way every person shall enjoy equal rights before the law, and no person may be favored due to their privileged position in society, whether financial or otherwise.

 Until such time as the world governments remedy the problems espoused above, it is my submission that one of the best interim solutions is for communities to collectively cooperate in curbing deviant behavior. One of the potential methods is to educate and warn others against deviant behaviour within communities, thereby preventing further people becoming victims, as well as to ostracise deviants and their deviant behaviour.

It is time for good people to collectively unite and demand a moral, safe and secure society. It is suggested that we manage our lives pro-actively, by educating the world and isolating deviants, thereby protecting people, business and society.
